Terms of Service

Effective September 23, 2026

Agreement

These terms govern your use of the Apex Panels web control panel, the Apex Panels companion app, and any Apex Panel Mini or Apex Panel Wide display paired to your account (together, "the service"). By creating an account or pairing a display, you agree to them.

They apply from September 23, 2026. Your use of the service is also covered by our Privacy Policy.

Your account

You need an account to pair a display, send messages, or use the Calendar. You must give an email address you control, and confirm it — until you do, features that reach other people stay unavailable to you.

You are responsible for keeping your password safe and for everything done through your account. Tell us promptly if you think someone else has access to it.

One person, one account. Don't share credentials, and don't register an address that isn't yours.

You must be old enough to enter a contract where you live. The service is not directed at children.

Your displays

A display registers itself to your account using a secret it generates on first setup. That pairing is how the display proves which account it belongs to, and it is why a unit already claimed by someone else cannot be re-registered without a factory reset.

A factory reset removes the display's registration entirely. It will re-register as a new unit on next setup, and its previous settings are not recoverable.

Displays are designed to keep working offline using cached settings and pre-downloaded content. Features that need our servers — pairing, new messages, Calendar, weather, firmware updates — need a working internet connection.

We push firmware updates over the air. Updates are signed and verified by the display before installing, and we may release them to fix security issues, correct faults or add features.

Acceptable use

Don't use the service to do any of the following:

  • Send content that is unlawful, harassing, hateful, threatening, sexually explicit, or that infringes someone else's rights.
  • Impersonate another person, business or organisation, including in a display name, a Showcase message or a calendar event.
  • Send unsolicited bulk or commercial messages, or use messaging or the public calendar for spam.
  • Attempt to gain unauthorised access to another account, another person's display, our servers, or any part of the service you were not granted access to.
  • Probe, scan or disrupt the service, circumvent rate limits, or interfere with anyone else's use of it.
  • Reverse-engineer, tamper with or work around the firmware signing, pairing or authentication mechanisms.

Messaging requires an accepted connection between both people — a friend request, or two displays meeting in person. Messaging limits (currently three scheduled slots per recipient per day, up to seven days ahead) exist to keep the feature usable and are not a target to work around.

Content you provide

You keep ownership of the content you create — messages, Showcase text and layouts, calendar events, support correspondence. You grant us the permission we need to store it, transmit it to the recipients and displays you direct it to, and show it back to you.

You are responsible for the content you provide, and for having the right to use it.

Public calendar events are moderated before publication, and may be rejected or removed. Other users can report an event or block an organiser, and we may act on those reports.

We may remove content or suspend an account that breaches these terms, or where we are required to by law.

Hardware, orders and returns

Displays bought from our store are sold subject to the terms shown at checkout, including price, shipping and returns.

Nothing in these terms limits any consumer guarantee you have that cannot be excluded by law. In Australia, our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Displays are designed for indoor and parked-vehicle use. They are not intended to be operated by a driver in a moving vehicle, and you are responsible for complying with the road rules that apply where you are.

Service availability

We work to keep the service running, but we do not promise it will be uninterrupted or error-free. We may change, suspend or withdraw features, and we will try to give reasonable notice where a change materially affects how you use the service.

Planned maintenance, an outage at a provider we depend on, or a fault in your own network can all interrupt the parts of the service that need connectivity.

Ending your use

You can stop using the service and delete your account at any time from Account Settings. Deleting an account removes your data as described in the Privacy Policy.

We may suspend or close an account that breaches these terms, that is used to harm other users, or where we are required to by law. Where it is reasonable to do so, we will tell you why.

Liability

To the extent the law allows, the service and the software on the displays are provided as-is, and we are not liable for indirect or consequential loss, lost data, or loss of profit or opportunity arising from your use of the service.

Nothing here excludes liability that cannot lawfully be excluded, including under consumer protection law.

Changes to these terms

We may update these terms as the product changes. When we do, we will update the effective date at the top of this page, and for material changes we will give notice in the app or by email.

Continuing to use the service after a change takes effect means you accept the updated terms.
